PART A — GENERAL TERMS OF USE

1. Introduction

Welcome to Daan Foundation (“Daan Foundation,” “the Foundation,” “we,” “us,” or “our”), accessible at [daanfoundation.in]. Daan Foundation is a registered charitable trust operating in India. These Terms and Conditions (“Terms”) govern your access to and use of our website, and your participation in any donation, sponsorship, or charitable programme offered through it.

2. Acceptance of Terms

By accessing this website, making a donation, or otherwise using our services, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy. If you do not agree with any part of these Terms, please do not use this website or make a donation through it.

3. Eligibility

By using this website or making a donation, you represent that you are at least 18 years of age, or are using the website under the supervision of a parent or legal guardian, and that you have the legal capacity to enter into a binding agreement.

4. Definitions

  • “Donor” means any individual or entity making a contribution through the website.
  • “Beneficiary” means any individual or family identified by the Foundation to receive assistance under a charitable programme.
  • “Campaign” means any specific fundraising or distribution programme run by the Foundation (e.g., Iftar Fund, Ration Kit, Community Kitchen, Qurbani).
  • “Services” means the website, donation processing, and charitable distribution activities carried out by the Foundation.
  • “Programme Partner” means an independent organisation (such as Qurbani Easy) that collaborates with Daan Foundation to operationally deliver a specific charitable programme.

5. Website Use & User Conduct

You agree to use this website only for lawful purposes. You shall not:

  • Use the website in any way that could damage, disable, or impair its functioning;
  • Attempt to gain unauthorised access to any part of the website, servers, or connected systems;
  • Upload or transmit any material that is unlawful, defamatory, obscene, or infringes on the rights of others;
  • Use any automated system (bots, scrapers) to access the website without prior written permission.

6. Intellectual Property Rights

All content on this website — including text, graphics, logos, images, the Daan Foundation name, and website design — is the property of Daan Foundation or its licensors and is protected by applicable intellectual property laws. No content may be reproduced, distributed, or used commercially without prior written consent from the Foundation.

7. Donations & Payment Terms

  • All donations made through the website are processed via a third-party payment gateway. Daan Foundation is not responsible for any technical failure, delay, or error caused by the payment gateway or the donor’s bank/payment provider.
  • Donors are responsible for ensuring the accuracy of the information (amount, category, contact details) provided at the time of donation.
  • A donation confirmation/receipt will be issued electronically to the email address provided by the donor. Tax exemption certificates (where applicable, e.g., 80G) will be issued separately as per the Foundation’s applicable policy and registration status.

8. Privacy Policy

Your use of this website is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using this website, you consent to such collection and use as described therein.

9. Third-Party Links

To the maximum extent permitted by applicable law, Daan Foundation shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the website or participation in any donation or campaign, including but not limited to loss of data, technical failure, or third-party payment issues.

12. Indemnification

You agree to indemnify and hold harmless Daan Foundation, its trustees, officers, employees, and volunteers from any claim, liability, loss, or expense arising out of your misuse of the website or violation of these Terms.

13. Force Majeure

Daan Foundation shall not be held responsible for any delay or failure in performing its obligations (including campaign execution or distribution) due to events beyond its reasonable control, including natural disasters, government restrictions, pandemics, strikes, or technical/infrastructure failures.

14. Termination & Suspension

Daan Foundation reserves the right, at its sole discretion, to suspend or restrict access to the website for any user found to be in violation of these Terms, without prior notice.

15. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts at Amroha, Uttar Pradesh, India.

16. Dispute Resolution

In the event of any dispute or grievance, the donor is encouraged to first contact Daan Foundation directly through the contact details below. The Foundation will make reasonable efforts to resolve the matter amicably before any other course of action is pursued.

17. Amendments to Terms

Daan Foundation reserves the right to modify or update these Terms at any time without prior notice. The revised Terms will be posted on this page with an updated “Last Updated” date, and continued use of the website after such changes constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

PART B — CHARITABLE PROGRAMME POLICIES

20. Donation Categories

Daan Foundation accepts donations under the following categories: Zakat, Sadaqah, Fidyah, Kaffarah, Iftar Fund, Community Kitchen, Ration Kit, Qurbani, and General Donation. Each category is managed according to its intended charitable purpose.

21. Fixed Contribution Campaign Policy

The contribution amount displayed on the website represents the sponsorship amount for the charitable programme. The donor sponsors the programme as a whole — not the internal procurement cost of individual items.

22. Iftar Distribution Policy

A contribution of ₹90 sponsors one Iftar meal. Distribution is organised only through Daan Foundation Community Centres and other authorised public distribution locations. Door-to-door Iftar delivery is not part of the regular campaign.

23. Priority to Fasting Individuals

Daan Foundation makes a sincere effort to distribute Iftar meals to individuals observing Roza. However, the Foundation cannot verify the fasting status of every recipient during public distribution.

24. Beneficiary Identification Policy

The Foundation makes reasonable efforts to identify deserving beneficiaries. During public distribution, it is not always practically possible to verify every individual’s eligibility. Distribution is carried out in good faith.

25. Iftar Meal Preparation Standard

Daan Foundation prepares meals in bulk using approximately 1 kilogram of raw rice per 5 servings — a standard of roughly 200 grams of raw rice per person before cooking. Side dishes are prepared according to Foundation recipes and are not individually weighed.

26. Serving Variation Policy

Meals are served in community batches, and minor variations in individual servings may naturally occur. Daan Foundation does not intentionally reduce the quantity or quality of food provided.

27. Community Kitchen Policy

Community Kitchen meals are sponsored on a per-person basis and distributed through Community Centres to individuals and families identified through the Foundation’s charitable process.

28. Ration Kit Distribution Policy

Each ration kit contains predefined items and quantities as published on the website. If any item is unavailable, it may be replaced with an equivalent or better item while maintaining the overall value of the commitment.

29. Ramadan Iftar Fund Transfer Policy

Daan Foundation generally completes its planned Iftar programme by approximately the 20th of Ramadan. Donations received after this point, where no further Iftar distribution is required, may automatically be transferred to the Community Kitchen Fund for post-Ramadan meal distribution.

30. Operational Expenses Policy

Unless specifically stated otherwise, donations received through the website may be used to cover website maintenance, payment gateway charges, communication systems, staff wages, technology, fundraising, audit, accounting, and other operational expenses required to run the Foundation.

31. General Fund Utilisation & Reallocation Policy

For donations other than Zakat, Daan Foundation may reallocate funds between charitable programmes and essential operational requirements whenever reasonably necessary to continue Foundation activities in good faith.

32. Assets & Infrastructure Policy

Assets purchased for Daan Foundation — including kitchen equipment, Community Centre infrastructure, computers, vehicles, technology, and other operational equipment — may be purchased from unrestricted donation funds and remain the property of Daan Foundation.

33. Human Resource Funding Policy

Daan Foundation may pay salaries, wages, and contractual payments to employees, field staff, programme coordinators, and other operational workers from unrestricted donation funds where applicable.

34. Transparency & Reporting Policy

Daan Foundation maintains internal records of procurement and distribution. Campaign photographs, videos, and reports may be published while respecting the dignity and privacy of beneficiaries.

35. Refund & Cancellation Policy

Refund requests may be considered before procurement or campaign execution begins. Once procurement, preparation, or distribution has started, donations are generally non-refundable.

36. Donor Consent

By donating, the donor authorises Daan Foundation to arrange the sponsored programme, identify beneficiaries through its own process, and complete distribution through Community Centres and other authorised locations.

37. Legal Disclaimer (Programme-Specific)

Daan Foundation makes reasonable efforts to fulfil every charitable commitment. Circumstances beyond the Foundation’s control may require rescheduling, substitution, or other operational changes.

38. FCRA & International Donations Policy

Daan Foundation is an Indian charitable organisation that operates only within the Republic of India.

38.1 FCRA Status. Daan Foundation does not hold registration under the Foreign Contribution (Regulation) Act, 2010 (FCRA). Accordingly: – Daan Foundation does not accept foreign contributions under FCRA. – International bank transfers, foreign currency donations, overseas payment gateways, or donations originating from outside India are not accepted on this platform. – Individuals residing outside India should not make donations through this website unless specifically permitted under applicable Indian law through a separate authorised arrangement.

38.2 Geographic Scope of Operations. All charitable activities, welfare programmes, food distribution drives, relief campaigns, educational initiatives, medical assistance, and community services organised by Daan Foundation are conducted only within India. Daan Foundation does not organise, administer, or execute charitable programmes outside the territorial jurisdiction of India. Any reference to activities outside India relates only to independent programme information and does not constitute an operational programme of Daan Foundation.

39. Qurbani Policy (In Collaboration with Qurbani Easy)

Qurbani Easy functions as Daan Foundation’s charitable programme and operational partner for organising Qurbani-related services.

39.1 Programme Partnership. All Qurbani bookings processed through Qurbani Easy are executed under the charitable framework of Daan Foundation in collaboration with Qurbani Easy. Qurbani Easy manages booking, coordination, beneficiary identification, documentation, and operational execution, while Daan Foundation oversees charitable implementation and compliance.

39.2 Distribution Policy. The Foundation follows a 100% charitable distribution policy for eligible Qurbani programmes.

  • Meat is distributed to eligible beneficiaries identified through the Foundation’s charitable network.
  • Distribution is prioritised for economically weaker families and communities.
  • Donors participate in the charitable programme and are not guaranteed delivery of meat to their personal address unless a programme explicitly states otherwise.

39.3 Religious Compliance. Every effort is made to organise Qurbani in accordance with applicable Islamic guidelines and the charitable objectives communicated at the time of booking. Operational factors such as logistics, weather conditions, transportation, public administration restrictions, or unforeseen circumstances may affect timelines without affecting the Foundation’s charitable intent.

40. Zakat Policy

Daan Foundation facilitates the collection and charitable distribution of Zakat funds within India.

40.1 Zakat Calculator Disclaimer. The Zakat calculator available on the website is provided only as an informational and estimation tool. The amount displayed may vary depending on an individual’s financial circumstances, may be higher or lower than the actual Zakat obligation, and should not be considered a binding religious ruling or fatwa.

40.2 Religious Consultation. Donors are strongly encouraged to consult a qualified Islamic scholar, Mufti, Maulana, or recognised religious authority for the accurate calculation of their Zakat obligation. Daan Foundation is not responsible for determining an individual’s personal Zakat liability.

40.3 Utilisation of Zakat. The Foundation makes reasonable and sincere efforts to ensure that Zakat funds reach eligible beneficiaries in accordance with the charitable purpose for which they are collected. Distribution is carried out through verified charitable programmes, beneficiary identification processes, and community support initiatives.

40.4 Communication Consent. Where required for donor communication, the Foundation may contact donors regarding acknowledgement, utilisation updates, clarification requests, or statutory communication relating to their donation.

41. Fidyah & Kaffarah Policy

Funds received under Fidyah and Kaffarah are handled separately from general charitable donations.

41.1 Dedicated Utilisation. Fidyah and Kaffarah contributions are primarily utilised through the Daan Foundation Community Kitchen Programme for preparing and serving meals to eligible beneficiaries, ensuring that the charitable purpose of providing food is fulfilled.

41.2 Ramadan Fidyah. During the month of Ramadan, Fidyah meals are generally organised as part of the Foundation’s Ramadan meal programme. The applicable Fidyah contribution may include the cost of preparing and serving an Iftar meal where applicable under the programme structure.

41.3 Restricted Use. Fidyah and Kaffarah funds are not diverted for unrelated charitable or administrative activities unless legally or operationally required for fulfilling the same charitable objective.

42. Donation Verification, Photography & Video Policy

Daan Foundation respects the dignity, privacy, and safety of beneficiaries.

42.1 Individual Verification. As a standard organisational policy, individual photographs or videos linked to a specific donor’s contribution are not routinely provided. Donations are pooled and implemented through charitable programmes wherever applicable.

42.2 Special Requests. Photo or video documentation may be considered only upon special request and subject to beneficiary privacy, operational feasibility, safeguarding policies, consent requirements, and organisational approval. Approval of such requests remains entirely at the discretion of Daan Foundation.

42.3 Programme-Level Documentation. The Foundation may publish general programme photographs, videos, reports, and awareness content for transparency and public communication without identifying beneficiaries unless appropriate consent has been obtained.

43. Communication & Beneficiary Welfare Policy

The Foundation’s primary objective is to provide humanitarian assistance with dignity and responsibility.

43.1 Priority of Communication. Organisational communication focuses on charitable impact, food assistance, beneficiary welfare, programme transparency, donor acknowledgements, and operational updates.

43.2 No Guarantee of Individual Coverage. The Foundation cannot guarantee that every charitable activity, distribution event, or beneficiary interaction will be photographed, recorded, or communicated individually.

44. Policy Updates

These policies may be revised, expanded, or updated from time to time to comply with applicable Indian laws, operational requirements, charitable governance standards, and organisational practices. The latest published version available through Daan Foundation shall be considered the governing policy.
